Department of Commerce Investigations: The Tennessen Warning

The Minnesota Department of Commerce is the regulator for many, many business sectors in Minnesota. Those sectors include real estate agents, appraisers, credit repair agencies, coin dealers, credit repair agencies, real estate closers, and mortgage originators.

img-feature1-gavel-booksFor several years I worked at the Department of Commerce, so I consider myself quite familiar with its rules and processes. If you are ever under investigation by the Department, one of the first things you should receive is a Tennessen Warning. Think of it as the administrative law version of the Miranda Warning.

Take the Tennessen Warning seriously and exercise your right to an attorney. The Department's investigators may come off as nice folks, but do not believe they have your interest in mind. The Department of Commerce can provide good services for consumers, but licensees under investigation usually do not express that same opinion.

Your livelihood is on the line when you are under investigation. I absolutely recommend that if you are under investigation you need to proceed very carefully and ensure your answers are accurate, succinct, and do not create troubles for yourself.
