Boundary Line Disputes: To Wait is To Lose

boundary disputeOne of the fundamental premises of the United States of America is our right to own land. We place great value on that premise and the law reflects it. But, while our real estate case law places the very demanding burden of proof of "clear and convincing" evidence with all inferences construed against the disseizor (the one trying to take the land), there is some chance the actual owner can lose.

The best way to avoid losing land to another is to address any possible concerns of boundary lines or use NOW. The sooner you address the unauthorized use of your land, the better your chances are of quashing an unwanted claim. The easiest way to cut off another's possible claim to your land is send a written notice granting permission to the use of your land until the final terms are agreed to between you and the invader.
