A recent settlement proposal is emblematic of what is properly seen as an abuse of the legal system. Doctor's Associates, Inc., more commonly known as Subway, recently announced a settlement proposal of class action litigation over the actual size of its sandwiches. Apparently some of the millions, if not billions, of sandwiches it sold were not exactly 12 or 6 inches, but were advertised as such.
Some consumers, or maybe more properly their lawyers, started a class action suit over the sandwiches being advertised those specific lengths. I have to wonder, Does anyone actually think or expect that the sandwich you buy is exactly the length advertised?
Fortunately for Doctor's Associates, Inc. it had the resources to defend itself. You and your company may not, so a proactive assessment of your business's risks is in order. Do so before you become the target.
